This Privacy Policy sets out our commitment to protecting the privacy of personal information provided to us, or otherwise collected by us, offline or online, including through any website owned and operated by us (each a Site), or via social media platforms, emails or phone calls. In this Privacy Policy, we, us or our means Beko A&NZ Pty Ltd ABN 49 152 055 162.  The purpose of this policy is to clearly state how we intend to meet our obligations under the Australian Privacy Principles (APPs) as set out in the Privacy Act 1988 (Cth) and the New Zealand Information Privacy Principles (IPPs) as set out in the Privacy Act 2020 (NZ) (Privacy Laws) in relation to the personal information we collect from you.

By accessing, browsing or using any of our Sites or otherwise providing your information to us, you acknowledge that you have read, understood and agree to be bound by this Privacy Policy as updated.  Since this Privacy Policy is subject to change without prior notice, you should check back on this Privacy Policy regularly.  All changes are effective from the date of posting the revised Privacy Policy.

Collection of Personal information

The types of personal information we may collect about you include:

·         your name;

·         your contact details, including email address, mailing address, street address and/or telephone number;

·         your demographic information, such as postcode;

·         information you provide to us through customer surveys;

·         additional personal information that you provide to us, directly or indirectly, through your use of our Site(s), associated applications, associated social media platforms and/or accounts from which you permit us to collect information such as date of birth, title, gender, or information related to your place of business;

·         if you use our Learning Management System (LMS) platform, your employment information and user account information, including your current employer, business unit division, personnel number and LMS platform login credentials such as account name and password; and

·         any other personal information requested by us and/or provided by you or a third party.

We may also collect the following information about you:

·         your browser session and geo-location data, device and network information, statistics on page views and sessions, acquisition sources, search queries and/or browsing behaviour; and

·         information about your access and use of our Site(s), including through the use of Internet cookies, your communications with our Site(s), the type of browser you are using, the type of operating system you are using and the domain name of your Internet service provider.

We endeavour to only collect these types of personal information directly from you, such as:

·         through our Site(s);

·         via email correspondence or via phone when you make an enquiry;

·         when you register a product with us;

·         when you leave a comment or review on our Site(s); or

·         via your use of the LMS platform. 

However, we may also collect these types of information from you from the following sources that you may be unaware of including:

·         from third parties (such as via contractors on our behalf or our internet service provider); 

·         publicly available sources; 

·         personal interactions with Beko employees; and 

·         electronic information from email or the Internet. 

In some circumstances if you do not provide the information that we request:

·         you may not be able to engage with us; 

·         we may not be able to provide goods or services to you;

·         we may not be able to perform obligations under a contract we have entered with you; or

·         we may be prevented from complying with our legal obligations (such as to ensure compliance with workplace health and safety obligations).

If we receive personal information about you from a third party, we will protect it as set out in this Privacy Policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.

Use of personal information

We will use your personal information for the reason we collected it and for any other reasonable business purposes, in that we may store and process information to provide you with the products and services you have requested.  We will generally use your personal information for the following purposes:

·         to provide you with the products and services you have requested;

·         to enable you to access and use our Site(s), associated applications, the LMS platform and associated social media platforms;

·         to understand your needs, to customise products and services to meet your needs and preferences, and to provide you with a better service;

·         to contact and communicate with you;

·         for internal record keeping and administrative purposes;

·         for analytics, market research and business development, including to operate and improve our Site(s), associated applications, the LMS platform and associated social media platforms;

·         to run competitions and/or offer additional benefits to you;

·         for advertising and marketing, including to send you promotional information about our products and services and information about third parties that we consider may be of interest to you;

·         to comply with our legal obligations and resolve any disputes that we may have;

·         to consider your employment application;

·         to perform our obligations under your employment contract, such as providing essential training modules and information relevant to your employment; and

·         for any other customer support purposes.

For information collected via the LMS platform, this information will not be used for advertising, marketing or competition/promotional purposes.

We may sometimes use the personal information we collect for a secondary purpose, that is, for use in a way different from the original reason for collection. We will only do this where the secondary purpose is directly related to the primary purpose, and you would reasonably expect us to use the information in such a way. 

Disclosure of personal information to third parties

We may disclose your personal information where: 

·         we have sought and obtained your consent; 

·         disclosure is necessary to achieve the purpose for which it was submitted; or 

·         we are permitted or required by law, or it is in the interests of public safety to do so. 

We may disclose personal information to: 

·         third party service providers for the purpose of enabling them to provide products and services on our behalf and performing our administration and other operations, including (without limitation) IT service providers, legal advisors, data storage, web-hosting and server providers, debt collectors, maintenance or problem-solving providers, technical, marketing or advertising providers, professional advisors, accounting and payment systems operators, record keeping and statistical service providers, fulfilment service providers and/or Site traffic analysts;

·         our employees, authorised service centres, contractors and/or related entities including affiliated entities within the Arçelik Group;

·         our existing or potential agents or business partners;

·         sponsors or promoters of any competition we run;

·         anyone to whom our business or assets (or any part of them) are, or may (in good faith) be, transferred;

·         other organisations with whom we have contractual agreements;

·         credit reporting agencies, courts, tribunals and regulatory authorities;

·         courts, tribunals, regulatory authorities and law enforcement officers, as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights;

·         third parties, including agents or sub-contractors, who assist us in providing information, products, services or direct marketing to you.

The above may include disclosures to parties located, or that store data, outside of Australia or New Zealand (as applicable to you) and third parties to collect and process data, such as Google Analytics or other relevant businesses.  Your personal information will be transferred to our parent company, located in Turkey and may be transferred to our offices in Thailand.

From time to time, we may provide aggregated statistical information about access patterns, navigational techniques, product popularity, etc. to reputable third parties. However, in all instances such information will simply comprise aggregated data and will not include any personal information that identifies any individual.

For information collected via the LMS platform, this information will only be disclosed within the Arçelik Group and its third-party service providers (as listed above), to the LMS platform provider and its IT service subcontractors, or where we are permitted or required by law, or it is in the interests of public safety to do so.  This information will be transferred to our parent company, located in Turkey and may be transferred to our offices in Thailand.  For clarity, this information will not be used by third party service providers for their own purposes.

By providing us with personal information, you consent to the disclosure of your personal information to third parties who reside outside Australia or New Zealand (as applicable to you).  We will not send your personal information outside of Australia or New Zealand (as applicable to you) unless:

·         It is necessary (including to provide the personal information to a third party) to provide our goods and/or services to you; 

·         You have provided your consent;   

·         We believed on reasonable grounds that the organisation involved would only deal with your personal information in a similar manner to the requirements under the APPs or IPPs; or

·         Where otherwise allowed by the Privacy Laws.   

Your rights and controlling your personal information

·         Restrict and Erase: You may choose to restrict the collection or use of your personal information.  If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by contacting us via the details below. You can also request that we erase any personal information we hold about you.

·         Access: You may request details of the personal information that we hold about you.  An administrative fee may be payable for the provision of such information.  In certain circumstances, as set out in the Privacy Laws, we may refuse to provide you with personal information that we hold about you.

·         Correction: If you believe that any information, we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us via the details below. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading or out of date.

·         Complaints: If you believe that we have breached the APPs or IPPs and wish to make a complaint, please contact us via the details below and provide us with full details of the alleged breach. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint.  We will aim to ensure that your complaint is resolved within a reasonable time, or the time required by any applicable legislation.

·         Unsubscribe: To unsubscribe from our e-mail database or opt-out of communications (including marketing communications), please either contact us via the details below or opt-out by using the opt-out facilities provided in the communication.

Storage and security

We are committed to ensuring that the personal information we collect is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the personal information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

We cannot guarantee the security of any information that is transmitted to or by us over the Internet. The transmission and exchange of information is carried out at your own risk and we will not be held responsible for events arising from unauthorised access to your personal information. Although we take reasonable measures to safeguard against unauthorised disclosures of information, we cannot assure you that the personal information we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy and no responsibility can be accepted for the conduct of third parties outside of our control. 

Cookies and web beacons

We may use cookies on our Site(s) from time to time. Cookies are text files placed in your computer's browser to store your preferences. Cookies, by themselves, do not tell us your email address or other personally identifiable information. However, they do allow third parties, such as Google and Facebook, to cause our advertisements to appear on your social media and online media feeds as part of our retargeting campaigns. If and when you choose to provide our Site(s) with personal information, this information may be linked to the data stored in the cookie.

We may use web beacons on our Site(s) from time to time. Web beacons (also known as Clear GIFs) are small pieces of code placed on a web page to monitor the visitor’s behaviour and collect data about the visitor’s viewing of a web page. For example, web beacons can be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page.

Links to other websites

Our Site(s) may contain links to other websites or embedded content (e.g. videos, images, articles, etc). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These other websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.  However, once you have interacted with this embedded content or used these links to leave our Site, you should note that we do not have any control over that content or other websites and we are not responsible for the protection and privacy of any personal information which you provide whilst visiting those websites. Remember, this Privacy Policy is strictly limited to our collection, storage and use of personal information collected via the Sites or otherwise in the course of our business and does not apply to any third parties. Those websites are not governed by this Privacy Policy, and you should exercise caution and look at the privacy policy applicable to the website in question.

Amendments

We may, at any time and at our discretion, vary this Privacy Policy by publishing the amended Privacy Policy on our Site. We recommend you check our Site regularly to ensure you are aware of our current Privacy Policy.  All changes are effective from the date of posting the revised Privacy Policy.
